Comments: The purpose of this Mitigation Banking Instrument is to establish guidelines and responsibilities for the establishment, use, operation, and maintenance of the Mitigation Bank. The Mitigation Bank will be used for compensatory mitigation for unavoidable impacts to Waters of the United States, including wetlands, which result from activities authorized under Section 404 of the Clean Water Act, provided such use has met all applicable requirements and is authorized by the appropriate authority or authorities. The Mitigation Bank will be solely used for Arkansas Department of Transportation (ARDOT) projects that require compensatory mitigation.
